Distance Sales Agreement
Distance sales agreement regarding online ordering services.
1. Parties
This Distance Sales Agreement is entered into electronically between Erzenler Et Sofrası and the customer placing an order through the website.
2. Subject
The subject of this agreement is the determination of the rights and obligations of the parties regarding the order placed by the customer through the website or QR Menu.
3. Order Process
Before completing their order, the customer is obligated to review the product information, prices, delivery fee, and total order amount. By confirming the order, the customer is deemed to have accepted the terms of the agreement.
4. Product and Service Information
The name, quantity, unit price, delivery fee, and total payment amount of the products subject to the order are clearly displayed on the order screen.
5. Payment
Payment is made using one of the payment methods offered during the ordering process. Security processes related to the payment infrastructure used are managed by the relevant payment institution.
6. Delivery
Orders are delivered to the specified address within the delivery areas served by the restaurant. Delivery time may vary depending on the restaurant's level of activity, traffic conditions, and other operational factors.
7. Order Preparation
The order is taken into the preparation process after customer confirmation. Requests for changes or cancellations for orders that have already begun preparation are subject to the restaurant's discretion.
8. Right of Withdrawal
Pursuant to Law No. 6502 on the Protection of Consumers and the relevant Distance Contracts Regulation, the right of withdrawal does not apply to food products that are perishable or may expire quickly.
9. Return Conditions
Returns are generally not accepted for food and beverage products that have been delivered, due to hygiene and food safety reasons. However, missing items, incorrect orders, or errors caused by the restaurant will be assessed and an appropriate solution will be provided.
10. Customer Obligations
The customer acknowledges that the information provided at the time of ordering is accurate and up to date. The restaurant is not liable for delays that may arise due to an incorrect address, missing contact information, or an unreachable phone number.
11. Restaurant's Rights
Erzenler Et Sofrası reserves the right to cancel an order or contact the customer to offer an alternative solution in the event of technical failure, insufficient product stock, force majeure, or extraordinary circumstances that prevent the provision of service.
12. Force Majeure
In the event of natural disasters, severe weather conditions, war, official authority decisions, technical infrastructure problems, or events beyond the control of the parties, the parties shall not be held liable to the extent they are unable to fulfill their obligations.
13. Protection of Personal Data
Personal data shared during the ordering process is processed within the scope of the Privacy Policy and KVKK Disclosure Text.
14. Dispute Resolution
In the event of disputes arising from this agreement, applicable consumer legislation shall apply. Authorized Consumer Arbitration Committees and Consumer Courts shall have jurisdiction.
15. Entry into Force
By completing their order, the customer declares that they have read, understood, and accepted this Distance Sales Agreement in electronic form.
